Thank you for choosing SKYFY as your Internet service and communications provider. Your privacy is important to us and to better protect your privacy, we provide this Privacy Notice (“Notice”) explaining our practices regarding personally identifiable information that may be collected in the course of providing products and services over SKYFY networks and systems, wireless or otherwise, and the choices you can make about the way your information is collected and used. This notice is available on our website at www.myskyfy.com. The Notice is hereby provided by SKYFY Networks (“SKYFY”) to SKYFY end-users, users, customers, and subscribers (collectively “Subscribers”) and is effective immediately.

Collected Information. As a subscriber to SKYFY products and services, you can now do many things online that make life easier and more fun: you can blog, purchase goods and services, pay for services, order products, vote in polls, play online games, obtain updates for software you bought, watch online videos, listen to music, register to receive material, use instant messaging and email services, view online content, download and upload various data and information, and participate in different online forums or other online systems where you may submit information. Some of this information might be viewable by third parties. The types of personally identifiable information that we may collect, in addition to the information you may disclose at your choosing, include but may not be limited to: name, address, email address, telephone/fax numbers, credit card information and information about your interests in and use of certain products, systems, programs and services. Depending on the services we provide to you, our records also may include information on billing, payment, damage and security deposits, maintenance and repairs, the number of computer devices you have connected to the SKYFY network or that are SKYFY enabled, the number and the location of these computer devices and their configuration, the service options you have chosen, and the number of other peripheral or additional hardware and/or software you have installed in your home.

SKYFY may remotely check your computer device(s) to the extent necessary to determine whether it is susceptible to unauthorized access or dissemination of computer viruses. SKYFY may also keep records of research concerning subscriber satisfaction with SKYFY services, which are obtained from subscriber interviews and questionnaires. Additionally, we may have a record of whether you rent or own your home in the event that landlord permission is required prior to installation of our facilities. SKYFY also maintains subscriber correspondence (email or otherwise) and we may keep records of violation and alleged violations of your End-User Service Agreement or your Terms of Service and other rules governing your use of SKYFY services. Finally, SKYFY may sometimes obtain from third parties publicly available information about our subscribers. In addition, you could submit information about other people (i.e. a person’s name, phone number and email address for technical support, as a referral, or to receive a gift). The types of personally identifiable information that may be collected about other people include but might not be limited to: recipient’s name, address, email address and telephone/fax numbers. Other information collected may also be certain non-personally identifiable information when you visit certain sites and/or web pages such as the type of browser you are using, the type of operating system you are using, and the domain name of your Internet service provider. This Notice pertains to personally identifiable information about you that you have furnished to us, or that we have collected, in connection with the provision of Internet services to you. Personal identifiable information does not include aggregate data that does not identify you.

The information described above is used for purposes such as: to make sure you are being billed properly for the services you receive, to send you pertinent information about our services, to maintain or improve the quality of our services, to answer questions from subscribers (i.e., troubleshooting), to ensure compliance with relevant law and contractual provisions, to market wireless or other services or products that you may be interested in, and for tax and accounting purposes. SKYFY systems, in delivering and routing the services, may automatically log information concerning Internet addresses you contact, and the duration of your visits to such addresses. SKYFY does not disclose any personally identifiable information that may be derived from these logs for marketing, advertising or similar purposes. The information collected over SKYFY systems in connection with your use of the services may be used in connection with the provision and maintenance of the relevant service and to fulfill transactions that you request, to personalize or improve your online experience, or as otherwise necessary in the course of our businesses (i.e., audits, billing matters, or research). SKYFY may also use this information to provide advertising and other offers for goods and services to you, subject to the marketing preferences you may select when using SKYFY services.

Use of Information. SKYFY may use the information you provide about yourself to fulfill your requests for our products, programs, systems, and services, to respond to your inquiries about our offerings, and to offer you other products, programs or services that we believe may be of interest to you. We sometimes use this information to communicate with you, such as to notify you when we make changes to our subscriber agreements, to fulfill a request by you regarding our online systems, forums, products and services, or to contact you about your account with SKYFY. We use information that you provide about others to enable us to send them your gifts. From time to time, we also may use this information to offer our products and/or services to them.

The information we collect in connection with our online programs, systems, forums and communities is used to provide an interactive experience. We use this information to facilitate participation in these online forums and communities and, from time to time, to offer you products, programs, or services. SKYFY sometimes uses the non-personally identifiable information that it collects to improve the design and content of our site and to enable us to personalize your Internet experience and use of our products and services. We also may use this information in the aggregate to analyze site usage, as well as to offer you products, programs, systems and/or services.

SKYFY uses return email address or an email address you provide to answer the email we receive. Such addresses are not used for any other purpose and are not shared with outside parties. You can register with our website if you would like to receive updates on our new products and services. Information you submit on our website will not be used for this purpose unless you fill out the registration form.

The types of persons to whom information about you may be disclosed by us in the course of providing service to you include our employees and those of our related legal entities, agents, repair and installation technicians and/or subcontractors, sales representatives, accountants, billing and collection services and credit reporting agencies, consumer and market research firms, and authorized representatives of governmental bodies. Also upon reasonable request, personally identifiable information is disclosed to persons or entities with an equity interest in legal entities related to use when they have a legal right to inspect our books and records. Additionally, SKYFY will disclose information it maintains when required to do so by law, for example, in response to a court order or a subpoena, or may be compelled to disclose information about you or your communications under exceptional circumstances (for example, such information may be disclosed to law enforcement if it appears to be evidence of child pornography, or was inadvertently obtained and appears to pertain to a crime). Such disclosure is also permitted to an addressee or intended recipient (or his/her agent), or to a person involved in forwarding such information to its destination; when necessarily incident to providing service or to protect SKYFY rights or property; to others with your consent or the consent of an addressee or intended recipient (or his/her agent) of communications sent by you; or otherwise provided for by law. Additionally, SKYFY may also disclose such information in response to a law enforcement agency request however, agents, partners, and contractors of SKYFY who have access to personally identifiable information are required to protect this information in a manner that is consistent with this Privacy Notice by, for example, not using information for any purpose other than to carry out the services they are performing for SKYFY. SKYFY may disclose information in our possession to protect our rights, property, and/or operations, or where circumstances suggest that individual or public safety is in peril.

From time to time, SKYFY may use subscriber data for new, unanticipated uses not previously disclosed in this Notice. If our information practices change some time in the future, we will post the policy changes to our web site to notify you of these changes and provide you with the ability to opt out of these new uses. If you are concerned about how your information is used, you should check back at WWW.MYSKYFY.COM periodically.

Although we take appropriate measures to safeguard against unauthorized disclosures of information, we cannot assure you that personally identifiable information that we collect will never be disclosed in a manner that is inconsistent with this Notice. Inadvertent disclosures may result, for example, when third parties misrepresent their identities in asking SKYFY for access to personally identifiable information about themselves for purposes of correcting possible factual errors in data. Therefore, we promote active involvement and participation from our subscribers in an effort to make sure that their data, accounts and systems and other SKYFY services they are using are secured and protected. SKYFY will not use or transfer personally identifiable information provided in ways unrelated to those as described above without also providing you with an opportunity to opt out of such uses.

Third Party Collection of Information. Some of SKYFY online products and services contain, embed, or integrate links to other sites, online products or parties whose information collection practices may be different than ours. Visitors should consult the other parties’ privacy notices as SKYFY has no control over information that is submitted to, or collected by, these third parties. SKYFY sometimes may offer contests, sweepstakes, or promotions that are sponsored by or co-sponsored with identified third parties. By virtue of their sponsorship, these third parties may obtain personally identifiable information that visitors voluntarily submit to participate in the contest, sweepstakes, or promotion. SKYFY has no control over the third-party sponsors/contractors use of this information and merely aims to make you aware that content and applications provided through its service may be provided by third parties, and that by accessing the online content of these third parties you may cause or enable the transmission by the system to them of personally identifiable information. The policies described in this Notice do not apply to such third parties. As noted, these third parties may have their own privacy policies, which you may also want to review.

Cookies. SKYFY may use cookies to enhance your experience with some of our online products and services. Cookies are text files we place in computer’s browser cache to store preferences and record session information, such as items that consumers add to their shopping carts. Cookies, by themselves, do not identify your email address or other personally identifiable information unless you choose to provide this information to SKYFY by, for example, registering at one of our sites. However, once you choose to furnish the site with personally identifiable information, this information may be linked to the data stored in the cookie. SKYFY uses cookies to understand site usage and to improve the content, layout, offerings, and overall usability of our online interfaces and sites. For instance, we may use cookies to personalize your experience at our web pages (e.g. to recognize you by name when you return to our sites), save your password in the password-protected areas, and make it easier for you to use our forums. Cookies may also be used to offer products, programs, or services.

Commitment to Security. SKYFY has integrated appropriate physical, electronic, and policy procedures to safeguard and help prevent unauthorized access, maintain data security, and correctly use information we collect online. We are constantly working to improve these measures in effort to provide you with safe and secure online experience.

Accessing and Correcting Your Information. To change or remove personally identifiable information that SKYFY has collected about you online, or how to correct factual errors in such information, please contact us by calling 1-888-977-5939 or contacting SKYFY Customer Care by logging into your Account Portal at WWW.MYSKYFY.COM. To protect your privacy and security, SKYFY will take reasonable steps to help verify your identity before granting access or making corrections.

Parental Control. SKYFY does not employ content filters or protection to protect children from explicit language or offensive content. SKYFY encourages parents to monitor their children when their children use Internet. If a child has submitted personal information or gives out other sensitive data on any of SKYFY systems please contact us by calling 1-888-977-5939 or contacting SKYFY Customer Care by logging into your Account Portal at www.MYSKYFY.com, and SKYFY will immediately remove such information. Protecting the privacy of the very young is especially important to us. For that reason, SKYFY does not collect nor maintain information from those it actually knows to be under 13, and no parts of SKYFY services are structured to attract anyone under 13. To protect your privacy and security, SKYFY will take reasonable steps to help verify your identity before removing information or making any corrections.

Contact Us. If you have any questions or concerns about SKYFY Privacy Policy or its implementation, you may contact us by calling 1-888-977-5939 or contacting SKYFY Customer Care by logging into your Account Portal at www.MYSKYFY.com. SKYFY maintains personally identifiable information about subscribers for as long as it is necessary for business purposes. This period of time lasts as long as you are a subscriber and up to fifteen additional years so that we can comply with tax and accounting requirements. When information is no longer necessary for these purposes, SKYFY destroys the information unless there is a legitimate outstanding request or order to inspect the information.

If you do not want to receive email from us in the future, please let us know by calling 1-888-977-5939 or contacting SKYFY Customer Care by logging into your Account Portal at www.MYSKYFY.com. If you wish to only supply us with your postal address online, you will only receive the information/product for which you have provided us your address. Persons who only supply us with their telephone numbers online will only receive telephone contact from us with information regarding orders they have placed online.

REFUND POLICY

SERVICE OUTAGES. A Service Outage is defined as either: (a) material non-compliance with a specific performance metric in a dedicated service level agreement; or (b) a complete loss of transmission or reception capability for the Service caused by the SKYFY Network. If there is a Service Outage, Customer must contact SKYFY at 1-888-977-5939, through www.MYSKYFY.com/support or by submitting an Online Support Case via Account Portal, if possible, and SKYFY will open a Support Case/Trouble Ticket and provide Customer with a Support Case/Trouble Ticket Number for tracking purposes to resolve the issue. A Service Outage is considered begun when Customer reports the Service Outage to SKYFY, and ends when the Service is restored. The duration of the Service Outage only includes outages that are caused by SKYFY Network and do not include outages caused by the Equipment, acts or omissions of Customer, whether negligent or otherwise, third parties, Force Majeure events, outages occurring during scheduled or emergency maintenance, and interruptions caused by failure of any equipment or service not provided by SKYFY. The duration of a Service Outage also does not include any time during which SKYFY is not allowed access to the Premises necessary to restore the Service(s).

If requested by the Customer, credit for the Service Outage (“Service Outage Credit”) may be issued to the Customer for an amount not to exceed the prorated monthly charges for Customer’s Service during the affected period. No credit will be given or adjustment made for Service interruptions lasting less than twenty-four (24) contiguous hours, starting from the time that you report the Service interruption to SKYFY which shall also define commencement of the Service Outage. If four (4) Service Outages have occurred on a particular Service during a thirty (30) day period, and a fifth (5th) Service Outage occurs within the same 30 days following the fourth (4th) Service Outage, Customer may terminate the applicable Service without early termination liability provided that Customer supplies SKYFY with a written termination notice no later than thirty days (30) following the fourth Service Outage. The foregoing credit will be your sole and exclusive remedy for any interruption of the Service or any degradation of performance of the Service. In order to be eligible for any such credit, you must request the credit in writing within forty-five (45) days of the commencement of the Service Outage. No credit will be available if the interruption period results from abuse, misuse, neglect, theft, vandalism, fire, unusual physical or electrical stress, water, extremes of temperature, other peril or act of God, your failure to comply with SKYFY instructions or the terms stated at www.MYSKYFY.com, or actual or attempted alteration of or additions to the Equipment or Service not approved by SKYFY, or from any problems with third party network elements that are not within the control of SKYFY, all as determined in the sole discretion of SKYFY.

Service Outages Not Caused by SKYFY Network. If SKYFY responds to a service call initiated by Customer, and SKYFY reasonably determines that the cause of the problem is not due to SKYFY Network, but is due to Customer’s equipment or facilities, or a third party, Customer must compensate SKYFY for the service call at SKYFY then prevailing rates. You acknowledge that the Service may not function in the event of power failure. A power failure or disruption may require reset or reconfiguration of the Equipment, which may or may not be executed remotely by SKYFY Customer Support, prior to utilizing the Service.

RIGHT OF CANCELLATION. CUSTOMER MAY CANCEL THIS CONTRACT WITHOUT ANY PENALTY OR OBLIGATION PRIOR TO THE PLANNED DATE OF INSTALLATION AND/OR ACTIVATION AND RECEIVE A FULL REFUND OF ALL PAYMENTS MADE. IF THE REQUEST TO CANCEL IS RECEIVED AFTER INSTALLATION HAS BEGUN OR ACTIVATION COMPLETED, CUSTOMER MUST PAY FULL TERMINATION LIABILITY SET FORTH BELOW. CUSTOMER MAY ALSO CANCEL THIS AGREEMENT IF THE SERVICES CEASE TO BE OFFERED AS STATED IN THIS AGREEMENT. IF CUSTOMER CANCELS THIS AGREEMENT FOR ANY REASON OTHER THAN THE REASONS STATED ABOVE, SKYFY MAY KEEP THE FULL AMOUNT EQUAL TO THE FINAL SERVICE PERIOD, NOT PRORATED, PLUS AMOUNT EQUAL TO THE COST OF ANY RELATED GOODS WHICH CUSTOMER HAS CONSUMED OR RETAINED.

SKYFY website on the World Wide Web with its home page in the domain “myskyfy.com”, or any other site operated by or affiliated with SKYFY Website (the "Website") is a complimentary information service offered by Website at no additional charge to users. SKYFY may provide links on the Website to other websites that may not be owned, operated and/or controlled by SKYFY. In general, any website that has an address (or URL) which does not contain “myskyfy.com” or "myskyfy.net” is such a website. These links are provided for convenience only and do not represent an endorsement by SKYFY of the organization or individual operating the Website or a warranty of any type regarding the Website or the information on the Website. You may provide a hypertext link to the Website on another website, provided that:

(a) The link must be clearly marked "SKYFY" or “MYSKYFY” as appropriate

(b) The link must "point" to the URL "http://www.myskyfy.com/" and not to any other pages within the Website,
